By using the Public Procurement Register, the user agrees to the terms of use of the register.
1. Definitions
1.1 Public Procurement Register – data, documents, and services available at https://riigihanked.riik.ee and its subdomains.
1.2 Controller – the State Shared Service Centre (as of 01.01.2024).
1.3 User – a person using the Public Procurement Register.
1.4 Special-purpose program – a program not intended for general web browsing or not directly controlled by a person. Special-purpose programs include, among others, scripts, bots, robots, and automated tools or programs not intended for web browsing.
2. General Provisions
2.1 The use of the Public Procurement Register is permitted only upon acceptance of all Terms of Use. By using the Register, the User unconditionally agrees to all terms of use.
2.2 The use of the Public Procurement Register includes the use of any document or dataset contained in the Register in any manner or for any purpose.
2.3 The following size and time limits apply to file uploads in the Public Procurement Register:
- 2.3.1 The size of an uploaded file must not exceed 100 MB.
- 2.3.2 The total size of a tender must not exceed 300 MB.
- 2.3.3 The maximum time allowed for uploading a file is 6 minutes. If the upload is not completed within this time, the file must be compressed, divided into smaller parts, or a faster internet connection should be used. For large files (>15 MB), an upload speed of at least 5 Mbps is recommended.
2.4 The Register may only be accessed with general-purpose web browsers. The Register supports Internet Explorer, Mozilla Firefox, Chrome, and Safari.
2.5 Access via special-purpose programs without prior written consent (in a reproducible form) from the the State Shared Service Centre is prohibited. This restriction does not apply to open data.
2.6 Electronic applications and tenders cannot be opened in the Public Procurement Register until one hour after the submission deadline. [Valid from 01.03.2021]
2.7 The submission deadline for tenders or requests can only be set from Monday to Friday, excluding public holidays, between 9:00 a.m. and 4:00 p.m.
2.8 If any provision of the Terms of Use is invalid due to conflict with the law, this shall not affect the validity of the remaining provisions.
3. Copyright
The copyrights to materials published in the Public Procurement Register, except for materials entered by Users, belong to the Controller.
4. Personal Data
4.1 In accordance laws with legislation regulating the protection of personal data, personal data are stored only with the User’s consent and only to the extent necessary for the functioning of the Register and its services. By submitting identification data, the User agrees that:
- 4.1.1 Their personal data will be processed and stored in the Controller’s information system;
- 4.1.2 Queries based on their personal identification code may be made to databases when necessary to ensure the functionality of the provided service.
5. User Rights and Obligations
5.1 The User has the right to use the Public Procurement Register free of charge in accordance with the Terms of Use.
5.2 The User has the right to seek assistance from user support during its working hours.
5.3 The User is prohibited from using the Register or services provided by the Controller for fraudulent or unlawful purposes.
5.4 The User must comply with all applicable laws and good practice when using the Register.
5.5 The User is prohibited from entering or uploading any materials into the Register, including posting questions, that are obscene, offensive, incite hatred, are threatening, or are otherwise inappropriate.
6. Rights and Obligations of the Controller
6.1 The Controller has the right to unilaterally amend the Terms of Use. Users will be informed of such amendments via the Controller’s website.
6.2 The Controller has the right to restrict User´s access to the Register if the User violates the Terms of Use.
6.3 The Controller is not responsible for the content of data entered or files uploaded to the Public Procurement Register by Users.
6.4 The Controller is not liable for delays, disruptions, or interruptions caused by circumstances beyond its control, such as force majeure, power outages, the User’s internet speed, disruptions in telephone or internet connections, or other electronic devices or systems, including software.
6.5 The The Controller is not liable for any damages or loss of profit arising from the use or inability to use the Public Procurement Register.
6.6 The Controller undertakes not to disclose User data to third parties, except in cases required by law for the prevention or investigation of offences, or for other justified reasons, such as conducting user surveys to improve the service.
